Not surprised to see “Ackman /Commons” withdraw their injunction case in Judge Lamberth’s District Court. First of all this has nothing to do with the “Fairholme lawsuit” or the “Ackman/Commons” Lawsuit in Judge Sweeney’s Court of Claims. This also has no bearing on the “Perry Injunction” appeal. This decision is not surprising at all considering Judge Lamberths recent decision in the Perry Injunction. It was plain to Ackman/Commons that they did not stand a chance with Judge Lamberth. I would caution against trying to read too much into this very common sense decision.
Now as much as I have criticized Judge Lamberth, and I still greatly disagree with his verdict let me add a few more thoughts. I always had misgivings about the Injunction cases.If I had my way, no Injunctions would have been filed at all. I felt this was a way to big of a decision to ask the Judge to forego a full trial and make a decision based on a limited amount of documentation. The governments attorneys have already demonstrated that they can not be trusted to be even remotely truthful; a full trial will be necessary to unravel the river of lies Our government has flooded upon this issue. I am confident that this gross injustice will ultimately be corrected, but an Injunction was simply not a smart way to achieve that.
I will be adding more analysis to the startling turn of events from yesterday. The disclosures made by Josh Rosner’s “source” added a whole new dimension to our cases. Keep the Faith!
